All services provided by Skyler Gunnuscio / SkyGunn (“Service Provider”) are subject to the following terms:
1. Services
Service Provider offers professional creative services, including but not limited to photography, videography, and related media services for real estate, architectural, corporate, and commercial projects. Final deliverables reflect the Service Provider’s creative judgment and interpretation.
2. Fees and Payment
A non-refundable payment of fifty percent (50%) of the total project fee is required prior to the commencement of services to secure booking. The remaining fifty percent (50%) is due upon completion and prior to final delivery unless otherwise agreed in writing.
Deliverables may not be published, distributed, or used until payment is received in full.
3. Scheduling and Cancellations
Appointments may be rescheduled with reasonable notice and approval from the Service Provider. Cancellations made with less than two business days’ notice may be subject to the full project fee.
4. Shoot and Production Conditions
Client is responsible for ensuring the location, subject matter, and environment are prepared at the scheduled time. Service Provider requires reasonable control of the working environment to ensure quality results.
5. Delivery and Revisions
Final deliverables are provided digitally. Basic editing and post-production are included unless otherwise specified. Additional revisions, edits, or reshoots requested due to creative changes or circumstances beyond the Service Provider’s control may incur additional fees.
6. Copyright and Ownership
All deliverables, including but not limited to images and video content, are the intellectual property of Skyler Gunnuscio / SkyGunn. Full copyright and ownership are retained by the Service Provider.
7. License and Usage
Upon full payment, Client is granted a non-transferable, single-party license to use the deliverables for marketing, promotional, or editorial purposes directly related to the commissioned project or brand.
Any third-party use, resale, sublicensing, or redistribution requires prior written consent from the Service Provider.
8. Liability
Service Provider is not liable for delays or failure to perform due to circumstances beyond reasonable control, including weather conditions, access restrictions, or acts of God.
9. Governing Law
These Terms of Service are governed by the laws of the State of Utah.
